Products such as swaps, forward rate agreements, unique choices and other unique derivatives are almost always sold by doing this. The OTC acquired market is the biggest market for derivatives, and is mainly unregulated with regard to disclosure of information in between the parties, considering that the OTC market is made up of banks and other highly sophisticated parties, such as hedge funds.
According to the Bank for International Settlements, who first surveyed OTC derivatives in 1995, reported that the "gross market value, which represent the cost of replacing all open agreements at the dominating market value, ... increased by 74% because 2004, to $11 trillion at the end of June 2007 (BIS 2007:24)."
